California courts make decisions on custody and visitation based on the best interest of a child, focusing on the history and nature of contact between the parents and the child, the child’s health, safety and welfare, history of alcohol or drug abuse,  history of domestic violence and numerous other factors. California law provides that a parent’s sexual orientation or behavior alone is not a relevant factor in determining the best interest of a child.  The courts’ recent decisions on lesbian parenting reinforce the principle that a parent’s sexual orientation is not a basis for determining the best interest of a child.
